Privacy Notice

This document is a working draft prepared for review. It is not a final privacy notice and is not a statement of regulatory compliance. It must be reviewed, adjusted and approved by Ecuadorian counsel before final publication, particularly with regard to Ecuador’s Organic Law on Personal Data Protection and its implementing regulations.

1. Who is responsible

Imperium Dei Legal Consulting Firm, attending from Urdesa, Av. Otto Arosemena, Guayaquil, Ecuador, is responsible for the processing of personal data collected through this website.

2. What we collect

We collect only the information you choose to give us through the consultation form or the published contact channels:

• Full name
• Telephone or WhatsApp number
• Email address
• City and country
• The service or practice area you are interested in
• The general description of the matter that you write
• Your preferred method of contact

The site may also record ordinary technical browsing data such as IP address, browser type, and date and time of access, generated automatically by the server.

3. Information we ask you not to send

The form on this site is not designed to receive confidential information. We specifically ask that you do not send original documents, case files, privileged information, sensitive data, or material covered by professional secrecy through this site or by messaging, until the firm has confirmed representation in writing and told you the appropriate channel.

The form does not accept file attachments.

4. Why we use it

• To respond to your inquiry and arrange the contact you requested.
• To carry out a preliminary evaluation of whether the matter falls within our areas of work.
• To check for conflicts of interest before accepting a matter.
• To keep an internal administrative record of inquiries received.

We do not use your information for advertising, we do not build commercial profiles, and we do not send bulk communications.

5. Basis for processing

Processing is based on the consent you give by ticking the corresponding box on the form, and on the need to take steps at your request prior to a possible professional relationship.

6. Who it is shared with

Inquiries are directed only to the firm’s legal email address. We do not sell, trade or transfer personal information for commercial purposes.

Information may be processed by the technical providers that make the website and email service work, acting as data processors. It may also be disclosed where there is a legal obligation or a requirement from a competent authority.

7. Retention

We keep inquiries for as long as necessary to deal with them and, where applicable, for the period required by applicable legal or professional obligations. After that, the information is deleted or anonymised.

Review note: the specific retention period must be set by the firm and validated by the reviewing lawyer.

8. Your rights

Under Ecuadorian personal data protection law you may request access, rectification, updating, erasure, objection to processing, portability and suspension of processing of your data, and you may withdraw your consent at any time.

To exercise these rights, write to genesisespinozabustamante@gmail.com setting out your request. You may also lodge a complaint with the competent data protection authority.

9. Security

We apply reasonable measures to protect the information we receive. No method of electronic transmission is completely secure, which is why we repeat that this site should not be used to send confidential information.

10. Cookies

This site uses only the technical cookies necessary for it to function, including those WordPress sets for administrator sessions and for the form to submit correctly.

At present no analytics, advertising, tracking or social media cookies are used, and there are no third-party integrations for those purposes. If any measurement tool is added in future, this notice will be updated and an appropriate consent mechanism will be implemented before it is activated.

You can configure your browser to block or delete cookies; doing so may affect how parts of the site work.

11. Minors

This site is not directed at minors and does not knowingly collect their information. Inquiries concerning children and adolescents should be made by their legal representative.

12. Changes

This notice may be amended. The version published on this page is always the version in force.
